QUALIFIED DOMESTIC RELATIONS ORDERS (QDROs)
QDROs are the one of the few areas of family law that cross into federal regulation. This is a very dense area of the law that, frankly, very few people have a deep understanding of.
A QDRO is an order that is drafted for the purpose of splitting interest in a retirement account. Two of the more common accounts in California include CALPERS and CALSTRS. Retirement accounts that are subject to these restrictions include accounts such as pensions, 401(k), 403(b), 457(b), annuities, and more. To further complicate matters, each plan administrator may require different language in their orders, or have different policies that we must be aware of. Because of its complicated nature, this is an area of the law that we typically will not advise someone to tackle on their own without the advice of an attorney.
